From notes by J. D. Ellis, John Ellis and siblings lost their mother sometime after the birth of Mary in 1665 and were orphans by November 6, 1669. The Kent Isle County Court assigned Alexander Maxwell as Adm. of John's estate and assigned John Griffith(?) as Guardian of the orphaned children. Later at a Talbot County Court, Thomas Emerson and John Mitchell posted 20,000 pounds of tobacco as security for John Griffith which the said Griffith must pay to the orphans when they came of age.

In 1676 John Ellis, age 15, petitioned the court to assign Michael Miller as his guardian. Michael Miller was a prominent lawyer, landowner and planter in Kent County and a member of the Vestry of St. Paul's Parish. It is not known why this man, who was a devout member of the Church of England, would elect to be the guardian of the son of a persecuted Quaker.

John Ellis, son of the Quaker John, did embrace the faith of the Church of England probably due to the early actions of his quadroon, Michael Miller.
